English term
any reasonable creature in being and under the Queen’s peace
English to Polish
Law/Patents
Law (general)
Context: Subject to these three exceptions the crime of murder is committed where a person of sound mind and discretion unlawfully kills any reasonable creature in being and under the Queen’s peace with intent to kill or cause grievous bodily harm.
:-)
(Under the Queen's Peace means that the defendant cannot be found guilty if they kill an enemy in the course of war. In contrast to this, the defendant in R v Page, a British soldier, was found guilty of murder, as they killed an Egyptian national whilst off-duty.)

racjonalnie myślące stworzenie i w czasie pokoju
"Reasonable creature in being" is a legal term that refers to a living being that possesses the capacity for rational thought and decision-making. This term is often used in legal contexts, particularly in discussions related to legal rights, obligations, and protections.
In the context of laws and regulations, "reasonable creature in being" typically refers to a human being who is capable of reasoning and making informed choices. This concept can be relevant in discussions about various legal matters, including issues related to personhood, rights, responsibilities, and ethical considerations.
It's important to note that the interpretation and application of this term may vary depending on the specific legal jurisdiction and the context in which it is used. Legal terminology can be complex and subject to interpretation, so consulting legal experts and official legal documents is recommended for a precise understanding of how this term is used in a particular context.
"Queen's peace," also known as "the Queen's peace," is a legal concept that refers to the state of order, tranquility, and protection within a jurisdiction or territory. It signifies a condition in which law and order are maintained, and individuals are safe from violence, harm, and unlawful activities. This concept is a fundamental aspect of maintaining social stability and the rule of law within a society.
In historical contexts, the phrase "Queen's peace" originally referred to the period during which the monarch's reign was marked by peace and stability. Over time, it evolved to refer to the general state of peace and security under the rule of law, regardless of the reigning monarch's gender.
In modern legal terminology, the phrase "Queen's peace" might be used more broadly to indicate the absence of violent disruptions and disturbances that threaten the safety and well-being of individuals within a jurisdiction. It's a fundamental principle that underpins the functioning of legal systems and law enforcement efforts.
Discussion
(A ta "zwykłość" będzie wynikać z dalszego opisu w dokumencie.
IMO_1 - trzeba krótko i logicznie okresliic ową niezwykłość w kontekście.
IMO_2 - trzeba zdecydować - jakiego tlumaczenia dla slowa "creature" użyć w kontekście pytania:
a) czy szlusując do epoki i oddać np. - "wasal" (co moze - byc nieco dziwaczne, choć niekoniecznie - jeśli użyje sie - "poddany");
Say - the question concerns ancient Troy, but we do not worry that Mr. Paris is long dead.
“Any reasonable creature”
“Reasonable” relates to the appearance rather than the mental capacity of the victim, and is apt to exclude monstrous births.
