Source text - Arabic Such a blended concept of democratic principles was essential for the transitioning of a tribal society to a modern one. HM the Sultan said in an interview with Foreign Affairs:
“I had promised on the first day of my rule to create a modern government. But I knew change had to be made slowly, very slowly. The level of education had to reach a certain point so that people would know what we were talking about.”
These words echo from the outset a commitment to building a nation based on democratic principles and values rather than taking the traditional path of family and tribal affiliations.
The Majlis Oman consists of two houses: Majlis Ad’dawla and Majlis A’shura.
Majlis Ad’dawla has a four-year term, which starts on its first meeting and in any case is not less than that of Majlis A’shura’s term. Majlis Ad’dawla members elect two deputy chairpersons from its members for the duration of its term.
The Majlis Ad’dawla has (7) seven committees; Legal Committee, Social Committee, Economic Committee, Human Resources Development Committee, Culture and Information Committee, The Committee for Women and Children Affairs and Education Committee.
National Media:
The media has achieved significant progress in the past few decades. It has facilitated the evolution of democratic principles in the process of transitioning a traditional tribal society to the modern age. Article 29 of the Basic Law guarantees freedom of opinion and expression in all forms. And, Article 31 facilitates freedom of the press, printing, and publication.
However, while Oman’s Basic Law validates the universality of human rights, it conforms to other international laws such as European Convention on Human Rights (ECHR). For example, Article 10 of European Convention on Human Rights (ECHR) provides the right to freedom of expression, subject to certain restrictions that are "in accordance with law" and "necessary in a democratic society". This right includes the freedom to hold opinions and to receive and impart information and ideas, but allows restrictions for:
• Interests of national security.
• Territorial integrity or public safety.
• Prevention of disorder or crime.
• Protection of health or morals.
• Protection of the reputation or the rights of others.
• Preventing the disclosure of information received in confidence.
• Maintaining the authority and impartiality of the judiciary.
Translation - English لقد كان هذا المفهوم المختلط لمبادئ الديمقراطية ضرورياً للتحول من مجتمع قبلي إلى مجتمع حديث، وقد صرح جلالة السلطان المعظم في مقابلة مع صحيفة فورين أفيرز :
" لقد وعدت منذ اليوم الأول من تولي للحكم أن أنشئ حكومة حديثة، ولكني أعلم أن التغيير لابد وأن يتم بصورة بطيئة للغاية، فلابد لمستوى التعليم من أن يصل إلى نقطة معينة حتى يعرف الشعب ما نتحدث عنه."
إن هذه الكلمات إنما هي صدى للالتزام الأولي ببناء أمة تقوم على مبادئ الديمقراطية وقيمها بدلاً من اتباع المسار التقليدي للانتماء العائلي والقبلي.
يتكون مجلس عمان من مجلسين هما: مجلس الدولة ومجلس الشورى
تمتد دورة انعقاد مجلس الدولة إلى أربع سنوات تبدأ منذ انعقاده الأول ولا يجب أن تقل مدة دورته عن مدة دورة مجلس الشورى بأي حال من الأحوال، وينتخب أعضاء مجلس الدولة من بينهم نائبين لرئيس المجلس لفترة انعقاد المجلس.
يضم مجلس الدولة (7) سبع لجان هي: اللجنة القانونية، واللجنة الاجتماعية، واللجنة الاقتصادية، ولجنة الموارد البشرية، ولجنة الثقافة والمعلومات، ولجنة شئون المرأة والطفل، ولجنة التعليم.
الإعلام الوطني:
حققت وسائل الإعلام تطوراً كبيراً خلال العقود القليلة الماضية، وأسهمت في نشر مبادئ الديمقراطية خلال عملية الانتقال من مجتمع قبلي تقليدي إلى العصر الحديث، وتؤكد المادة 29 من القانون الأساسي حرية الرأي والتعبير بكل الصور، وتجيز المادة (31) حرية الصحافة والطباعة والنشر.
ومع ذلك ورغم أن القانون الأساسي العماني يؤكد على عالمية حقوق الإنسان، فإنه يتوافق مع القوانين الدولية الأخرى كالاتفاقية الأوربية لحقوق الإنسان، فعلى سبيل المثال فإن المادة رقم (10) من الاتفاقية الأوربية لحقوق الإنسان تشير إلى الحق في حرية التعبير في ظل قيود معينة حيث نصت على أن يتم ذلك "وفق القانون" و"ضروريات المجتمع الديمقراطي". إن هذا الحق ينطوي على تحديد لحرية الرأي وتلقي ونقل المعلومات والأفكار إلا أنه يجيز قيوداً فيما يتعلق بما يلي:
• مصالح الأمن القومي.
• التكامل الإقليمي والأمن العام.
• منع الفوضى والجريمة.
• حماية الصحة أو الأخلاق.
• حماية سمعة وحقوق الآخرين.
• منع كشف المعلومات السرية.
• الحفاظ على السلطة ونزاهة القضاء.
