As between the parties, EMC, and its licensors, own and shall retain all right, title, and interest in and to: (i) the Software including all intellectual property rights embodied therein; (ii) all of the service marks, trademarks, trade names, or any other designations associated with the Software; and (iii) all copyrights, patent rights, trade secret rights, and other proprietary rights relating to the Software.

Autant utiliser le terme au sens le plus large dans le titre de l'article, puisque le détail vient par la suite. Titre de propriété est à mon avis trop restrictif.

Je ne prétends pas gagner des points, cela m'est totalement égal, mais : le titre de propriété est un document tangible, un acte juridique ; "propriété" employé seul désigne la propriété privée -- droit individuel de la propriété -- et la pleine propriété, type le plus achevé de droit réel... (Cornu, Vocabulaire juridique). Dans ce contexte il est clair que le concédant conserve les droits de propriété attachés au logiciel concédé sous licence ; il n'est pas fait mention expresse de l'acte juridique, sauf erreur de ma part. Vous verrez également dans les dicos juridiques bilingues courants (par ex. Lexique du Conseil de l'Europe) que "title" peut également se traduire par "droit de propriété".
