rape in Shelby County and received an eight-year Department of Correction sentence, to be
served consecutively to a three-year Department of Correction sentence in a separate case. On
appeal, Smith argues that the trial court erred in dismissing the petition because his eight-year
sentence has expired. After review, we affirm the trial court’s dismissal of the petition on
grounds that Smith has failed to establish that his sentence has expired.
