Ustawa o pomocy społecznej wprowadza definicję mieszkania chronionego, co oznacza mieszkanie „przeznaczone dla osób mogących, przy odpowiednim wsparciu, samodzielnie żyć w środowisku, w szczególności dla osób z zaburzeniami psychicznymi oraz osób opuszczających placówki opiekuńczo-wychowawcze, resocjalizacyjne, zakłady dla nieletnich i rodziny zastępcze” Nie precyzuje się dalej w ustawie żadnych wymagań odnośnie tego typu lokalu.
