SAISIE CONSERVATOIRE:
Inventaire dressé par un Huissier de Justice, à titre préventif. Elle sert de garantie au créancier et permet de figer des situations en bloquant les biens du débiteur dans l'attente d'un jugement. Elle peut porter sur des créances (comptes, loyers...) ou sur des biens meubles au domicile du débiteur ou entre les mains d'un tiers.

Je ne trouve pas de traduction pour ce terme ; apparemment il s'agit d'un concept que l'on trouve dans la législation des Etats de la Nouvelle Angleterre (Massachusetts, New Hampshire, Maine, Rhode Island.

In a number of states, including Massachusetts and some other New England states (New Hampshire, Maine, and Rhode Island), the court may allow you to attach bank accounts on an "ex parte" basis; that is, without notice to the defendant prior to judgment being entered. This may happen if a creditor is owed money either for goods sold or delivered or for personal services (such as advertising), and the court decides that judgment in the creditor's favor is likely, there is no insurance available to pay the creditor, and the defendant would likely either removeor secrete the money if given notice of the attachment. If the claim is against an agency, money owed to the agency by the advertiser can also be attached. This is called a "Reach and Apply" action if it is an unliquidated amount or it is not yet due and payable.

J'ai également trouvé des cas où cette "saisie" (sous réserve) semble tout particulièrement s'appliquer à des sommes dues au titre d'une police d'assurance (chercher "reach and apply" avec Google).

In such action, the interest of the defendant in partnership property may be reached and applied in payment of the plaintiff's debt; but unless it is a judgment debt, the business of the partnership shall not be enjoined or otherwise interrupted further than to restrain the withdrawal of any portion of the debtor's share or interest therein until the plaintiff's debt is established, and if either partner gives to the plaintiff a sufficient bond with sureties approved by the clerk, conditioned to pay to the plaintiff the amount of his debt and costs within thirty days after it is established, the court shall proceed no further therein than to establish the debt; and upon the filing of such bond, any injunction previously issued in such action shall be dissolved.
