**El Estado liberal-garantista** laissez faire, laissez passer, adscribe al Derecho la tutela y represión del orden (vigilar y castigar, nigtwatchman); el minimal state, es incompatible con el Estado social que frente a la neutralidad postula la imparcialidad, promueve la discriminación positiva (acciones de discriminación inversa y/o afirmación positiva, el uso y también, el abuso alternativo del Derecho), asume el Derecho premial y las sanciones positivas (Bobbio) y confiere al Derecho la función activa y positiva de promover la igualdad real y efectiva.
