Am 22. März 2011 hat die Staatsanwaltschaft gegen ein ehemaliges Vorstandsmitglied und einen ehemaligen Prokuristen der xxx denen Bestechung ausländischer Amtsträger vorgeworfen wird, Anklage bei dem Landgericht erhoben und beantragt, die Nebenbeteiligung der xxx anzuordnen.

Grateful for any help from legal experts. This is all the context available btw fpr this term.

Context from text insufficient Thank you all for your input. Phil, the sentence after this one is 'Zur Zeit läuft das sog. Zwischenverfahren, in dem das Gericht prüft, ob die Anklage zur Hauptverhandlung zugelassen wird', but it is not clear to me that this sheds any light on Nebenbeteiligung here. Both the terms suggested make sense to me in this context. I think my best option is to ask the client precisely what is going on here and then choose the term.

Agree with Phil and by implication Ellen It is difficult to really tell here without more context... it looks as if the public prosecutor applied to have xxx joined on the indictment. From previous experience of translation of such cases, it could be that a corporate defendant is being added to the indictment.

I initially agreed with Kim's answer, but then I thought Ellen might have a point. Are they asking the court to find them guilty of aiding and abetting, or merely to order them to stand trial along with other accused parties?

This refers to section 442 of the Strafprozessordnung. You could say 'order him to participate in the proceedings as a secondary party'. 'Joinder' is the right idea but it sounds too civil to me. I link to a translation below, but this is not the perfect translation

Artikel 3 befasst sich mit der Nebenbeteiligung an einer Bestechung in Form von Anstiftung und Beihilfe. Er geht nicht auf versuchte Straftaten ein[3].
Article 3 focuses on secondary participation in corruption through instigation, aiding and abetting. It does not address attempted offences[3].
