رغم أن هذا النص استمد بشكل واسع، من معاهدات لاهاي للقانون الدولي الخاص(...)، إلا أن الظرفية الاستثنائية التي صدر في ظلها أصبغته بخصوصية في مجال تنازع القوانين، حيث استجاب لوضع سياسي قائم إذ ذاك أضحى متجاوزا اليوم، الشيء
الذي أتاح للقضاء إقرار حلول في إطار القانون الدولي الخاص مخالفة لما هو معمول به في معظم الأنظمة القانونية المقارنة، وعلى الأخص في مجال القواعد العامة للإسناد، والتي كانت محل تأييد واسع وتبرير مغالى فيه من لدن الفقه الأجنبي كما سيلي البيان.

لم يرصد ظهير 12 غشت 1913 مقتضيات تتعلق بالقواعد العامة للإسناد، وقد سمح ذلك لفقه وقضاء الحماية باستغلال هذه الثغرة التشريعية وتصريف سياستهما الهادفة إلى ضمان الاحترام المطلق للقوانين الأجنبية وخاصة في مجال الأحوال الشخصية، وذلك بإقرار مفاهيم مجافية للاتجاهات السائدة في القانون الدولي الخاص المقارن كتكييف العلاقة محل النزاع طبقا للقانون الأجنبي والرفض التام للإحالة وإنكار أي دور للنظام العام في مجال تنازع القوانين.

The text is about القانون الدولي الخاص in Morocco.
