In an otherwise non-legal text, a client has thrown in a couple of data privacy statements. I'm not clear on what this is referring to. It appears in a section entitled ENCARGADO DEL TRATAMIENTO, which I understand to mean 'data processor' in the context of GDPR. Can anyone help me out? Spanish from Spain for UK English.

Here is the full sentence:

Si [company name] actúa en virtud de un encargo de tratamiento de datos personales por el cual recoge, trata o utiliza datos personales, las partes firmarán un acuerdo adicional de encargado del tratamiento en el cual se establezcan los detalles sobre la recogida, tratamiento o utilización de los mismos.

Instruction, engagement, commission, assignment, tasking... Tom West III's ES/EN dictionary says encargo is synonymous with a pedido.

I've gone for commission, to be consistent, if ENCARGADO DEL TRATAMIENTO is translatable as a Data-Processing Commissioner (vs. Officer).
Example sentence:

Thanks. I tend to use 'engagement' for auditing and accounting assignments, whereas my Spanish Canarian 'guanche' ex kept on at me about an all-exclusive and, hence, unrealistic 'engagement'.

If you do not like "by virtue of", "in accordance with"/"pursuant to" will also do the trick.
