ВОЗНАГРАЖДЕНИЯ
(a) Право Исполнителя на продолжение выполнения работ может быть прекращено письменным извещением, если после уведомления и разбирательства руководитель агентства или назначенное им лицо определит, что Исполнитель, его агент или иной представитель --
(1) Предлагал или передавал вознаграждение (например, в виде развлекательного мероприятия или подарка) должностному лицу, служащему или сотруднику Правительства; и
(2) Намеревался посредством этого вознаграждения получить контракт или добиться благоприятного отношения в рамках контракта.
(б) Факты, послужившие основой для такого решения, могут быть рассмотрены любым судом надлежащей юрисдикции.
(в) При расторжении настоящего контракта на основании пункта (а) настоящей статьи Правительство имеет право --
(1) Применить те же средства защиты, что и в случае нарушения контракта; и
(2) В дополнение к любым иным правам на возмещение убытков, предусмотренным законодательством, наложить поучительный штраф в размере от трех- до десятикратной суммы расходов, понесенных Исполнителем в связи с предоставлением вознаграждения указанному лицу, причем величина такой суммы устанавливается руководителем агентства или назначенным им лицом. (Настоящий подпункт (в)(2) применяется только в случае, если при выполнении настоящего контракта используются денежные средства, ассигнованные Министерству обороны.)

COMPENSATIONS
(a) The Right of the Contractor for continuation of works can be stopped by the written notice if after the notice and handling the agency head or the appointed by him person has stated that the Contractor, its agent or other representative -
(1) Offered or transferred compensation (for example, in the form of entertaining action or a gift) to an official, an employee or a Government employee; and
(2) Intended by means of this compensation to receive the contract or to achieve the favorable relation within the limits of the contract.
(б) The Facts which have formed a basis for such decision can be considered by any court of appropriate jurisdiction.
(в) At cancellation of the present contract on the basis of point (a)of the present article the Government has the right --
(1) To Apply the same protection means, as in case of contract infringement; and
(2) In addition to any other rights for the contribution of damage provided by the legislation to impose the instructive penalty at the amount from three –to enfold amount of the expenses suffered by the Contractor in connection with granting compensation to the specified person, thereby the amount of such sum is established by the head of agency or the person appointed by him. (The present subparagraph (в)(2) it is applied only in case if at the execution of the present contract the cash recourses assigned to the Ministry of Defense Ministry are being used.
