[principio de] legalidad-taxatividad

Seth Phillips Oct 12, 2023:
Taxatividad doesn't mean exhaustive Quite the opposite. There is a reason why "limitativo" appears in the text (which in my view is redundant, but probably inserted for explicitation purposes). As per my answer, the principle is rather about the requirement of criminal laws being well defined, clear enough for ordinary people to grasp.

Thank you. Here's what I found. I understand taxatividad to mean exhaustive, but am confused by limitativo before it.

To save us from looking it up... What does article 19.3 of the constitution say?

3.2. PRINCIPLE OF LEGALITY
3.2.1. OVERVIEW
A central tenet of human rights law that applies
directly to the international criminal law system is the
principle that prohibits retroactive application of
crimes and penalties. To incur criminal responsibility,
behaviour must be prohibited and carry criminal
sanction at the time of conduct. This is known as the
principle of legality or nullum crimen sine lege and
nulla poena sine lege. The principle of legality is an
important principle in international criminal law, given
the often imprecise nature of the sources of ICL (e.g.
customary international law).

In extradition

Under the principle of specificity, the demanding state can prosecute the extraditee only for the offense for which the extradition was granted and may not extradite the detainee to a third country for offenses committed before the initial extradition. Although states have recognized certain exceptions to this principle—and some…

Spanish term (edited): [principio cardinal limitativo de] legalidad-taxatividad

[restrictive, cardinal doctrine of] exhaustively delimited legality

It's limitativo bunded by commas, so the principle itself must be restrictive, rather than limiting or restrictive of the legality-exhaustiveness.

Doctrine for principio, la doctrina equating rather with legal writing and literature.

Otherwise, I found a different wording of Article 19 of the Chilean Constitution, the question definitely headlined Chile.

I am unsure that, post-Pinochet (cut to my Chilean victim-friends in West London 1980), the 'principle of 'legality-specificity', if indeed makes sense to a lay readership, is a term of art and on all fours with the context / hallowed writing in point:

'Under the principle of specificity, the demanding state can prosecute the extraditee only for the offense for which the extradition was granted and may not extradite the detainee to a third country for *offenses committed before the initial extradition*.' https://www2.proz.com/personal-glossaries/entry/12752582-pri...
Example sentence:

One of the standard techniques of regulation by rules is to use general categorisations as opposed to exhaustive lists.

[T]he principle of legality requires not only that the crimes be defined by law, but also that the prohibited conduct be clearly delimited in the law.

Peer comment(s):

agree Toni Castano : Lex certa principle (= taxatividad, see Liz below), as a part of the legality principle (= legalidad), but unsure if comprehensible as such in the Anglo-Saxon legal system.

Void-for-vagueness Principle / Doctrine

I think Liz suggestion of "Specificity" could work for taxatividad. I had a look at Rebecca Jower's lexicion with a section on Legality Principle, which includes a principio de taxatividad. She renders it as "Void-for-vagueness principle," and more descriptively as "Principle that penal laws must be clear and unambiguous."

Principio de Lex Certa (Lex Certa Principle), Mandato de Lex Certa and Mandato de Determinación are synonymous. Mandato de Tipicidad might also. This SCIELO article talks about this Principle and has taxatividad, mandato de determinación / tipicidad in the same sentence:

"Una de las garantías básicas del principio de legalidad consiste en el mandato de determinación, de taxatividad o de tipicidad,2 conforme al cual el legislador penal debe establecer normas de sanción suficientemente determinadas, excluyendo disposiciones imprecisas que puedan ser manipuladas por el órgano de persecución o los tribunales con competencia en lo criminal.3"

This paper gives an good description of Lex Certa Principle:

"A general requirement within criminal law is that potential offenders should, on the basis of the legality principle (the lex certa principle), know whether an act they intend to commit will fall under the criminal law or not."
https://www.researchgate.net/publication/256012631_The_Lex_C...

Many lawsuits happen in the US over the issue of vague criminal laws. And void-for-vagueness doctrine is often a legal point in the argumentation, like this Pennsylvania decision:

“[T]he void-for-vagueness doctrine requires that a penal statute define the
criminal offense with sufficient definiteness that ordinary people can understand what
conduct is prohibited and in a manner that does not encourage arbitrary and
discriminatory enforcement.”

So I would argue that it is not merely to specify, but define a law in a manner that is clear for ordinary people to understand. This would be a quality of Tipificación (defining a crime in a statute) in Spanish-speaking jurisdictions.

However, Specificity might work in other areas of law like securities law, not concerning criminal law.
