I think the term is used to describe payment of bail - as the accused needs to submit required sum, this needs to be done by their attorney. This has a few reasons, one of them being that the accused is in custody so cannot easily go to the bank, and also the cheque in the olden days was a sign of trust - as an accused they (and their cheque) could not be trusted. So the attorney was effectively putting their cheque in as a sign of being ready to defend them (their reputation) in the future hearing - menaing giving some kind of guarantee that the accused is not going to skip bail and run...
